تلقى الأسير السابق ، الباحث المختص عبد الناصر فروانة اليوم اتصالاً هاتفياً من محامية " جمعية نساء لأجل الأسيرات السياسيات " الأستاذة " تغريد جهشان " التي أكدت تعرض الأسيرة القاصرة إلى التحرش الجنسي وأنها تقدمت بشكوى ضد السجان ، وأنها وبعد تقديمها الشكوي تعيش في زنزانة انفرادية في قسم العزل في ظروف قاسية .

"نساء لأجل الأسيرات السياسيات " ترافقن بشديد القلق منذ الشهر الأخير الأسيرة السياسيه القاصرة التي تقدمت بشكوى تحرش جنسي ضد احد السجانين في سجن الشارون إثناء احتجازها هناك.

محامية الجمعيه, تغريد جهشان , التي زارت الأسيرة مرات عديده خلال الفتره الماضيه أرسلت في يوم 6-9-2009 رسالة مستعجلة جدا إلى مأمور مصلحة السجون ارفقت نسخ عنها إلى مسؤول المنطقة الوسطى وآخرين من مصلحة السجون وكذلك إلى رئيس لجنة السجون التابعة لنقابة المحامين قي إسرائيل .

فى تاريخ 14-9-2009ولعدم استلام جواب على الرسالة أعلاه, أرسلت رسالة مستعجلة أخرى والتي لم تحظى هي أيضا بأي جواب خطي .

الرسالة تضمنت ادعاءات بالغة الشدة من قبل الاسيره والتي دعمتها بتصريح مشفوع بالقسم جاء بها ان مصلحة السجون تنكل بالاسيره لتقديمها الشكوى وذلك بنقلها لقسم عزل/ فصل في سجن آخر للأسيرات الجنائيات , دون ان يكون لذلك أي أساس قانوني واحتجازها في ظروف غير انسانيه : الغرفة خانقه, لا تدخل اليها أشعة الشمس, رطبه, بدون تلفاز, مروحة, كتب (ما عدا كتاب واحد احضرته من السجن السابق ) ومواد للأشغال اليدوية .

إضافة لذلك أخذت منها أغطية الرأس . زد على ذلك النمل الذي يملاْ الغرفة ويمنعها من النوم في الليل . وهكذا فانه على ارض الواقع تواجدت الاسيره ما يقارب 24 ساعة بين الجدران بدون أية وسيله لتمضية الوقت .

كل هذه التفاصيل كتبت لمأمور مصلحة السجون, وبالرغم من ذلك كله لم يستصوب ارسال رد خطي على الادعاءات هذه ، والاسواْ من ذلك , انه كما يبدو وبعد ارسال الرسالة تم رش القسم بمواد مبيدة للحشرات ،  الاسيره أخرجت من الغرفة لبضع دقائق فقط ثم أدخلت بعدها مباشرة وأغلق عليها الباب ، نتيجة لذلك شعرت بالاختناق , الدوران والغثيان لعدة ساعات وبعدها استمر شعور بالألم في الصدر .

في يوم 15-9-2009 فقط, وبعد مضي أسابيع على الظروف المذكورة أعلاه التي احتجزت بها , نقلت الاسيره الى غرفة اخرى ظروفها معقولة ولكن في نفس قسم العزل / الفصل .

جهات مسئوله من السجن قامت بالاتصال هاتفيا مع المحامية جهشان فى الأيام الاخيره وأبلغتها بان موضوع الاسيره يعالج على أعلى المستويات لايجاد حلول لنقلها من القسم المذكور أعلاه إلى مكان آخر .

موقفنا واضح في الموضوع : الاسيره السياسية يجب أن تكون في قسم الأسيرات السياسيات ولا توجد هناك حلول أخرى .

الجهات المسؤوله اياها وعدت المحامية جهشان بنقل قرارها إليها في الموضوع يوم الاثنين 21-9-2009 في حال عدم تجاوب القرار مع المطلوب سوف يقدم التماس فوري باسم الاسيره إلى المحكمة .

بالنسبة لشكوى الاسيره ضد التحرش الجنسي والتي وكلت بها أيضا المحامية جهشان تدلي الاسيره بالأقوال التالية : أنها ستواصل النضال إلى أن ينال السجان عقابه .

من الجدير بالذكر ان " نساء لأجل الأسيرات السياسيات " على اتصال وثيق مع العائلة التي تعلم كافة التفاصيل .

Urgent Call

Since the last month WOFPP has accompanied, with deep concern, the minor political prisoner who complained of sexual harassment by one of the guards in Hasharon Prison where she was held.

WOFPP's lawyer, Taghreed Jahshan, visited the prisoner many times during the recent period and has sent a very urgent letter, on 6 September 2009, to the Prisons Service Commissioner, with copies to the Central Area's Commander and other persons of the Service Prison staff and to the Chairman of the Bar Association's Prisons Committee.

Since there was no reply, another urgent letter was sent on 14 September, and again it had not been answered in writing.

The letter raised serious claims of the prisoner - verified by affidavit – according to which, following the complaint she has submitted, the Prisons Service harassed the prisoner, by transferring her to another prison to the isolation/separation wing in which criminal prisoners are being held, without any legal basis, and holding her in inhuman conditions: a stuffy, very damp cell, without any sunlight, without TV, ventilator, books (except one book she brought with her) and without handicraft materials. The prison authorities also had taken from the prisoner her head coverings. In addition, there were many ants in the cell that disturbed her sleep at night. In fact, the prisoner sat about 24 hours a day facing the walls without anything to occupy herself with.

All these details were reported in a letter to the Prisons Service Commissioner; however he did not see fit to reply in writing concerning these claims. Even worse, probably following the letter, insecticide was sprayed in the wing. The prisoner was taken out of her cell for a few minutes and, immediately after the spraying, she was returned. As a result, she was overcome by feelings of suffocation and dizziness for some hours, and she continued to feel chest pain.

Only on 15/9/09, after a month during which the prisoner was held in the conditions described above, she was transferred to a cell with reasonable conditions, but still in the same isolation/separation wing.

These last days, staff members in charge at the prison where the prisoner is detained, made telephone contact with attorney Jahshan and told her that the most senior ranks handle the matter of the prisoner, aiming to find a solution for her by transferring her from the wing which she is held in.

Our position is clear in this matter: a political prisoner should be in a political prisoners' wing - there is no other solution.

The same staff members promised attorney Jahshan to update her on Monday 21 September 2009. If the decision that will be taken will not meet the required objective, a plea in the prisoner's name will immediately be submitted to the court.

Regarding the prisoner's complaint against sexual harassment (attorney Jahshan represents her also in this matter): The prisoner says that she will continue to fight until the guard will get the punishment he deserves.

It should be noted that WOFPP is in close and continuous contact with the prisoner's family which is updated on every detail.

The minor prisoner has been held in isolation/separation for over a month and probably will have to spend the holiday of Eid-elFiter alone.

Profondément préoccupée, WOFPP a accompagné - depuis le mois passé - une prisonnière politique mineure qui s'est plainte de harcèlement sexuel par un gardien à la Prison de Hasharon, où elle a été détenue.

L'avocate de WOFPP, Taghreed Jahshan, a visité la prisonnière à maintes reprises au cours de la période récente et, le 6 septembre 2009, a envoyé une lettre urgente au Commissaire du Service des Prisons (Prisons Service Commissioner) avec des copies au Commandant du District Central et à d'autres personnes du Service des Prisons, et au Président du Comité des Prisons de l'Association des Avocats en Israël.

Puisqu'il n'a y avait pas de réponse, le 14 septembre une autre lettre urgente a été envoyée et, cette fois aussi, il n'y avait pas de réponse écrite.

La lettre a présenté des revendications sérieuses de la prisonnière – vérifiées par une déclaration sous serment – affirmant que, à la suite de la plainte qu'elle avait faite, le Service des Prisons a harcelé la prisonnière en la transférant à l'aile d'isolement/séparation d'une autre prison où les prisonnières criminelles sont incarcérées, sans fondement légal, et en la détenant sous des conditions inhumaines: Une cellule humide et mal aérée, sans un seul rayon de soleil, sans télé, ventilateur, matériel pour travaux à main et sans livres (à l'exception de celui qu'elle avait apporté elle-même). Les autorités de la prison lui ont pris ses couvres-tête. En plus, il y avait d'innombrables fourmis dans la cellule qui ont troublé son sommeil. En effet, la prisonnière était assise les 24 heures du jour à regarder les mur de la cellule sans aucune occupation.

Le Commissaire du Service des Prisons a été informé de tous ces détails par une lettre; pourtant, il n'a pas daigné envoyer une réponse écrite concernant ces revendications. Encore pire - probablement à la suite de cette lettre - de l'insecticide a été pulvérisé dans l'aile. La prisonnière a pu quitter sa cellule pendant quelques minutes, mais immédiatement après la pulvérisation elle a dû y retourner. Le résultat en était un sentiment de suffocation et d'étourdissement pendant quelques heures, et elle a continué a avoir des douleurs de poitrine.

Ce n'était que le 15 septembre 2009, après un mois de détention sous les conditions décrites ci-devant, que la prisonnière a été transférée à une cellule où les conditions étaient plus acceptables, mais toujours en détention d'isolement/séparation.

Ces jours-ci, des membre du personnel de la prison où la prisonnière est détenue ont contacté l'avocate Jahshan et l'ont informée que des responsables de grade supérieur s'occupent de l'affaire de la prisonnière, afin de trouver une solution en la transférant de l'aile où elle est détenue.

Notre position est claire: une prisonnière politique doit être détenue dans l'aile des prisonnières politiques – il n'y a pas d'autre solution.

Les mêmes membres du personnel ont promis que, lundi le 21 septembre 2009, ils informeront l'avocate Jahshan des développements. Si, toutefois, la décision prise ne correspondra pas à la requête, une pétition au nom de la prisonnière sera présentée au tribunal.

En ce qui concerne les plaintes de la prisonnière contre le harcèlement sexuel (l'avocate Jahshan la représente aussi dans cette affaire): La prisonnière a dit qu'elle allait continuer la lutte jusqu'à ce que le gardien reçoive la punition qu'il mérite.

À noter: WOFPP est en contact étroit et constant avec les membres de la famille de la prisonnière et les informe de chaque détail.

La prisonnière mineure a été détenue en isolement/séparation pendant plus d'un mois et, en toute probabilité, elle sera seule pendant la fête de Eid-el-Fiter.

קריאה דחופה

מזה יותר מחודש, "נשים למען אסירות פוליטיות" מלוות מתוך דאגה עמוקה את האסירה הפוליטית הקטינה אשר התלוננה על הטרדה מינית מצד אחד הסוהרים בכלא השרון בו היא הוחזקה.

עורכת דין העמותה, תגריד ג'השאן, ביקרה את האסירה פעמים רבות במשך התקופה האחרונה ושלחה ביום 6/9/09 מכתב דחוף ביותר לנציב שירות בתי הסוהר עם העתקים למפקד גוש מרכז ואחרים בשירות בתי הסוהר וכן ליו"ר ועדת בתי הסוהר של לשכת עורכי הדין .

בתאריך 14/9/09, מאחר ולא נתקבלה כל תשובה, נשלח מכתב דחוף נוסף אשר גם הוא לא זכה לתשובה בכתב.

במכתב הועלו טענות חמורות של האסירה אשר אומתו ע"י תצהיר, לפיהם שירות בתי הסוהר מתנכל לאסירה בעקבות הגשת התלונה, ע"י העברתה לכלא אחר לאגף בידוד/הפרדה בו מוחזקות אסירות פליליות, ללא כל בסיס חוקי והחזקתה בתנאים תת אנושיים: התא מחניק, לא מגיע אליו אור שמש, מלא רטיבות, ללא טלויזיה, מאוורר, ספרים (למעט ספר יחיד שהביאה מהכלא הקודם) וחומרים למלאכת יד. בנוסף נלקחו ממנה כיסויי הראש. על כל אלה יש להוסיף את הנמלים שמילאו את התא והפריעו לה לישון בלילות.

 למעשה, האסירה ישבה כ-24 שעות ביממה אל מול הקירות ללא כל תעסוקה.

כל הפרטים הנ"ל דווחו במכתב לנציב שירות בתי הסוהר ואף על פי כן הוא לא מצא לנכון לענות בכתב על טענות אלה. חמור מזה, ככל הנראה בעקבות המכתב, עשו באגף ריסוס נגד חרקים. האסירה הוצאה מהתא למספר דקות בלבד ומייד לאחר הריסוס היא הוחזרה. כתוצאה מכך נגרמה לה הרגשת חנק וסחרחורות במשך שעות וכן המשיכה להרגיש כאבים בחזה.

רק ביום 15/9/09, וזאת לאחר כחודש ימים שבהם הוחזקה האסירה בתנאים המתוארים לעיל היא הועברה לתא בו התנאים סבירים אבל עדיין באותו אגף בידוד/הפרדה .

גורמים אחראיים בכלא בו מוחזקת האסירה קיימו קשר טלפוני עם עו"ד ג'השאן בימים האחרונים ומסרו לה כי עניין האסירה מטופל ע"י הדרגים הבכירים ביותר על מנת למצוא פתרון להעברתה מהאגף הנ"ל למקום אחר.

עמדתנו ברורה בעניין: אסירה פוליטית צריכה להיות באגף של אסירות פוליטיות ואין כל פתרונות אחרים.

אותם גורמים הבטיחו לעו"ד ג'השאן לעדכן אותה בהחלטתם ביום שני 21/9/09. במידה וההחלטה אשר תתקבל לא תענה על הנדרש תוגש לאלתר עתירה בשם האסירה לבית המשפט.

באשר לתלונת האסירה נגד הטרדה מינית (מיוצגת גם בעניין זה ע"י עו"ד ג'השאן): האסירה אומרת כי תמשיך להיאבק עד אשר הסוהר יבוא על עונשו.

יצויין כי "נשים למען אסירות פוליטיות" בקשר הדוק ורציף עם המשפחה אשר מעודכנת בכל פרטים.
